R.I.P. '99 Sable

    My '99 Mercury sable with just under 242,000 miles bit the dust today! She lost a rod or 2.

    Was running better than usual for the past couple of months, I should of known to check the oil but nobodies perfect! Finally the oil light flickers slightly in the higher RPM range so I check the oil and nothing. Added 3 quarts and still nothing, added 1 more and the dip stick read 1 quart low! Put another quart in for a total of 5 QUARTS!!! WTF? Oil light doesn't come on until a 5 quart system is 5 flocking quarts low?!!! Then the dam thing only flickers in the higher RPM range!

    This had the dual overhead cam 3.0L engine in it, was told designed by Porsche but instead of 12 cylinder, only 6. With over 200,000 miles on the clock the dam thing clicked off low 15 second QM runs!(probably why 15 seconds QM times doesn't impress me, LOL)

    The thing would run better and better the lower the oil level would get, maybe adding the oil helped to kill it? :Do No: If it wasn't stupid winter freezing flocking cold I would of opened the hood more than I did and maybe the turd would still be alive!

    Here's the bad part, my truck is dead in the water, plagued with electrical gremlins that are NOT my strong suit plus the gremlins showed up the same time as the freezing flocking cold! Thought I would be able to drive the '99 until at least March but I guess not!

    My '65 has a broken coil spring in the front with balding drag radial tires on the rear but is looking like the least expensive option to be able to drive my elderly mom to her doctors appointments from where on the way home from one of her appointments is where the Sable threw a rod! She is short and can't get into my truck with her bad knees but she could easily get into the '65 Impala. Plus her wheelchair would easily fit in the trunk, a whole lot better than the Sable's trunk!

    The worst part of the story is that my POS sister had control of my mom's checking account to pay the bills over there and she did everything but!! Had to take a leave of absent from my job to take care of my mom and had to drain my bank account to bail out her house from foreclosure because the POS left her accounts with zero $$ in her checking and only $5.50 in her savings account! My sister, a real see you next Tuesday that can't understand normal thinking! So yeah, a double one of those! She got a credit card in my mom's name and maxxed it out to $3K and stopped paying on it, she didn't pay the taxes for 2 years on both of my mom's houses and there was an over $2,000 electric bill on her house!! And those are just examples of the tip of the iceberg!

    So while I have no income and not much $ in the bank and trying to catch up to all the unpaid bills with my mom's partial pension from my deceased dad and reduced social security, and with my mom's credit worthless because of the POS my only options for now is to get one of my classics up and running to drive my mom to her Doctors appointments! :rant:

    Get through this year and next year should be smooth sailing with the house up north sold and my house reconfigured for my mom to move in then sell her house things will get much better!

    I hope everyone that reads this is doing better than I am and doesn't have a sister like mine!

    Thankfully NOT, but you are not alone. I hate to tell you HOW MANY "Stories" I've heard over the yrs. about the same things happening when least expected.

    Dang Derek, I thought I had problems with the "Penguins" but your problems make my problems seem tiny. I hope this year gets better for you. I'm an eternal optimist. Things always get better. I'll keep you in my thoughts and stay warm good buddy. The days are getting longer.

    I would check with law enforcement. What your sister did was embezzlement. plain and simple. Even a higher crime if your Mom is considered disabled and unable to manage her own financial affairs. I have heard of similar cases where the person was prosecuted. I would feel no guilt, relative or not, to nailing her for what she has done. She has already proven that she could care less about anyone but herself.

    I went through a similar episode with my sister. She was living with my mom when my mom passed away. The house was left to me but since my sister had nowhere to live, I told her she could stay there. All she had to do was pay the small mortgage ($159/month), property tax & utilities. A great deal for a nice little house in a safe neighborhood.
    The first problem came when she didn't pay the property tax. I received a notice that the house was going to be sold at auction for unpaid property taxes. So I had to pay the back property taxes and all the fees associated with stopping the sale. Then almost a years later I had a registered letter delivered to my home saying that they were foreclosing on my mom's house! Turns out my sister stopped making the payments and had not made a payment in over six months! She had been throwing all the late notices in the trash. It cost me another pile of money to get that straightened out.
    I had to tell her that this arrangement was not working out and that she would have to find another place to live because I was selling house. So now the house is sold, she is renting a house, and the miracle is that now she pays all of her bills on time...

    Your a good son stepping in and picking up the pieces, and helping mom the best you can!

    Thanks for all the support and kind words fellas, unfortunately my mom isn't on board with prosecuting my criminal sister!

    My sister after all the crap she pulled had the gall to threaten that she would get a lawyer to contest the will if its changed and my mom dies within 2 years of it being changed(some sort of elder law). So if that happens my mom won't be around to stop me from prosecuting her for elder abuse, embezzling and whatever other charges to the FULL extent of the law can be brought up on her! I'll even sue her for lawyer fees so when she is in jail her ill gotten S/S disability will go right to pay the lawyer!

    Here's the kicker, myself and my 2 brothers were going to let my loser sister have both houses basically everything for taking care of mom. Which she really wasn't doing, she had her loser live in boy friend doing all of the work to take care of her! When she dumped him being white trash rich twice a month she was paying an aide that would only take her about an hour and a half a day to do it herself! Which would of been fine with plenty of $$ to get some help once and a while if she didn't over spend and under save!

    The dumb B would ask me to come over to help with bills and when I did I told her to spend less and pay bills more set up a budget for her and told her if she needed anymore help to just ask. Well come to find out she didn't want help to figure out the bills, the B wanted $$ from me to help pay the bills! LOL like I would hand that stupid B any cash! Between my mom's $$ and her S/S disability(which is less than $750 a month) the house hold had just over $4K a month to keeps things a float! With only a tiny $350 equity loan on the house but she needed to save $300 a month for the property taxes for both houses so $650 out of $4k and about $150 a month in medication co-pays for my mom's pills and another around $200 a month for miscellaneous needs for my mom. Then the gas, electric and water bills needed to be paid, should be another couple hundred, lets even say $500, that leaves $2,500 a month excess, that wasn't enough to make ends meet, WTF?!!!

    Anyway I hope no one else has to deal with this type of POS sibling. And hell yeah I will miss that Sable WAY more than that POS sister of mine!

    Not if your mom changes her will to read that "If anyone contests her will, they are automatically out of the will and receive nothing"! Something to check into.....

    My parents had a similar clause in theirs and it shut my family up in a hurry. :TU:

    You could consider an ante mortem hearing which would establish the validity of your mom's will BEFORE she passes away if your state provides for such. The language which discourages contesting a will without valid basis is termed an"in terrorem" clause.

    Thanks Sean! Yeah it will get better but the hurrying up and waiting is the hardest part!

    Don't worry though as soon as I get my truck running and able to steal some time I plan on making the trip to Dave's shop and play with a sbb 350 block. I will let everyone know how the block turns out.

    Dang Derek, hate to hear all that. Hope it gets better soon. My brother isn't quite that bad but has given my Mom trouble in the past when he was on pills. He's doing 'ok' now but we still keep an eye on things. My sister and I have been taking Mom to her weekly chemo treatments and doctor appointments for the last 5 months so I feel your pain there.

    if she gave her access and isn't warded under her care all she can do is file charges herself but his mom would have to do it and take her to court. If she is warded you can charge sis with neglect. still a court case anyway you look at it and not something the police would really be involved with. there going to refer you to the court system. she had access so its not really theft and your going have to sue her. not embezzlement cause she is not a business or she wasn't a paid contracted employee to handle her funding.

    This is incorrect legal advice for many reasons for many, if not most, states. Here is the Michigan Larceny by Embezzlement criminal statute:

    MCLS 750.362 *(2016)

    750.362.**Larceny by conversion.

    Sec. 362.***Larceny by conversion, etc.--Any person to whom any money, goods or other property, which may be the subject of larceny, shall have been delivered, who shall embezzle or fraudulently convert to his own use, or shall secrete with the intent to embezzle, or fraudulently use such goods, money or other property, or any part thereof, shall be deemed by so doing to have committed the crime of larceny and shall be punished as provided in the first section of this chapter.

    This is not always true. Any legal counsel can give you exceptions.

    Both Gokitty and I have been licensed to practice law for more than 40 years. If you are not so licensed, do not give legal advice. Even if you are be very careful, especially when dealing with the laws of another state.

    First off I would like to thank the practicing lawyers for the great advice and the others that have spoken their thoughts as well.

    Here is an update;

    Found a buyer for the Sable, the guy has a Torus within a couple of years of the Sable that needs a transmission so he is going to buy is for $400.

    Decided not to drive the '65 instead I fired up one of my K-5 Blazers to drive. Of coarse the weather was on the warmer side and with the tires sunk in the ground from sitting in the same spot for a couple of years(about 3") it dug the rear tires in even deeper when I fired it up!! So then at night when the ground was more on the frozen side I figured I would start it back up and try to get it out of the spot its in, well the dam thing wouldn't start for anything! So the next day I try again to get it started earlier in the day while it was still cooler, to no avail!! I then pulled a spark plug to see the plugs were fowled out, ok so I go and get new plugs 2 heat ranges hotter and after I get them in I barely had to hit the key for it to start but by then the ground is softened up so it just digs itself in deeper!!

    That brings me to yesterday, VD, so the spot where the K-5 is parked is back to back with the other K-5 about 10 feet apart. I used the parked K-5 to connect them together with chain and a come along to pull it out. At first all it did was pull the parked one while the one running in reverse doesn't budge! I was thinking perhaps the front brakes may be locked up so I had a sheet of 4' by 8' plywood outside that was leaning when I put it there but was lying flat on the ground when I got it so it is water logged and frozen and on the other side of the yard that I dragged to put under the front of the K-5 to jack it up to make sure the front wheels weren't locked up. All that work to drag the plywood and jack and the tires spun freely with a kick of my foot! Now I was like ok lets try to shovel a ramp to help get the thing going, BINGO that's what it needed.


    I ratcheted the come along and it started getting easier, one more ratchet and it was out and zooming my way! Stupid me tries to stop it, after all it was only idling but I couldn't even slow the dam thing down and rammed my leg into the other bumper and pinned it there!!!(OUCH!) I was on the drivers side of the moving K-5 with the front wheels slightly turned to the right so the bumpers were no longer parallel to each other. With that angle it hit my leg on the inside of my thigh and now to get my leg out that was under a but load of pressure I had to get the bone through the pinch point of how the angle was! At this point I was in excruciating pain screaming at the top of my lungs with the pressure felt like it kept building. I don't know how I got my leg out with the bone on the wrong side of the angle but I managed to pull free. I fell to the ground out of breath with my heart beating a million beats a seconds.(not really a million but really fast!) I had to get up because the exhaust was right there and didn't want to breath that in especially while out of breath, so I hobble up and sat in the K-5, shut it down while I caught my breath.

    Anyway come to find out the dam thing was in low lock!! Even though the front hubs aren't working right now, if they were it would of never got stuck. Its hard to tell what gear the transfer case is in because there is a NP 203 behind a 700R4 instead of the NP 208 that comes bolted to the 700s. And with the linkage sticky its really hard to make it shift to feel what gear its in. Plus the shifter is set back further that a NP208 would be and the indicator for what gear its in for the NP 203 is on the shifter knob so not real easy to tell where that is without being able to shift it through the gears. If it was in high gear I would of been able to stop it, actually it would of stopped itself. I managed to yank the shifter to get it in one of the high gears, not sure which one but it drives down the road now to get to my mom's house to care for her.

    A friend of mine found a car I can buy for $1,000, a 2002 Pontiac Sunfire with only 86,000 miles on it! It is at his shop on the hoist and the bottom looked almost new and the rest of the car looked even better! I should be able to get my mom to and from all of her DR. appointments with this car, its only a little 4 cylinder turd car but should work for now.

    I don't think I broke my leg, mostly muscle pain where it got smashed. Using my dad's old cane for now to help me get around, still in a whole lot of pain when I have to bend or put weight on my right leg but still able to drive. Wish I had help at the time but I got it done, although the price to pay was a bit high, its done. Would be driving a brand new 2017 something lease vehicle if I wasn't in this situation and didn't have to take the leave of absence from work! I guess if it wasn't for bad luck I wouldn't have any luck at all! It sucks to be me but someone has to do it, wouldn't wish this life on anyone. :rant:

    Getting the plate transferred at the Secretary of State is another rant I'll spare everyone from. LOL Thanks for reading.
