Hi all, I need some advice here on enforcing an ebay transaction. As we all know, an ebay bid is a contract. That said, how do I enforce it if the seller backs out of it cause he got an offer after the auction of more money for what I bought. Basically he was happy till the greed monster paid him a visit. The car was $1,300 and is local to me. The other guy has offered him $1500 for it, and I dont feel I should have to play that game. Advice anyone.... and no, I dont want to toilet paper his house. uzzled: ok, maybe I do...... -Jon

The auction ended with me as the high bidder, but the reserve was not met. However, he sent me a "second chance offer" thorugh ebay for a buy it now of $1300. My high bid was $1,100. So I hit buy it now and sealed the deal. So by all rights its like any other buy it now on ebay. And no, it was not mentioend for sale locally. -Jon
if the car is gone...sold already....the best thing 2 do is forget about it....thats my opinion... if this ebay seller sells or buys often on ebay..you can be a bad boy and follow him around on his ebay sell or buy items and smear him with the other sellers or buyers......if your even a real bad boy you can ****** ******* **** never mind.....its cheeper than toilet paper,, :Brow: :Brow: there is plenty of games played on e-bay...I hate when their buddies bid 2 rack up the $$$... ..they watch near the end..and watch how many times you up-the bid...they r hoping you want it bad and keep going.....them scammers... ..I remember a few years ago seeing the usual same dozen names bidding on 4-5 cars within 2 hours of bid ending...imagine what 12 guys on phones can do...while on ebay...ou:
I hate that too. I am appealing to his ethical side that he will see how wrong his behavior is. The guy has not given him the cash for the car yet. Man, it was a completely resotred 72 Convertible with front end damage. Hood Bumper and Grill. The rest of the car was clean. Thats a hard one to walk away from..... -Jon

Frank, the official name for having your friend bid up an item is called shill bidding. I think I spelled that right. Officially e-bay does not allow it, but we all know it happens. As for the seller backing out of the transaction, probably hard to get any help from e-bay. I agree, try to reason with the guy, but ultimately have to just leave a negative feedback and that is about all you can do. He is wrong to not honor the "legally binding contract", but the problem is the enforcement. Not sure what else you can do, e-bay does not seem to want to get involved in many cases unless it improves their financial position. They have nothing to gain here, the seller is already paying the commission.
Jon Tell him you spoke to an attorney that plans to file suit for specific enforcement. Tell him defending himself will cost a lot more than $200. Good luck and Sam's Club has the best price on toilet paper. ________ Outdoor japanese
