help me out here. am i unreasonable?

  1. lets say you inquire of a seller/vendor on an item and they describe in writing the condition in detail and based on those details you agree to buy said item, then before item has even been shipped the seller contacts you and states hey, I was wrong in my description the item does in fact have some of the issues you stated you absolutely wanted to make sure didnt exist before purchasing. am I "flaking out" or being unreasonable by asking to unwind the purchase? item is still in sellers possession..

    X2...you are not being unreasonable. I don't care if it's a board member or not. You have no obligation to follow through with the deal, and if the seller feels the item is great, he can sell it to somebody else easily.

    It's not unreasonable. If item is not as described = NO SALE! Does the seller have your money already?
     
  5. in the sellers defense the issue wasn't discovered until he was prepping the item for shipping and he did let me know.
     
  6. yup. and when I asked to unwind the deal it was referred to as me "flaking on the deal" thats what really burns me up.

    I think we all have to agree that buying and selling stuff is subjective in some ways. Most of us know what is a "mint" or "new" part is - everything else might be subjective to people - that is why you have to communicate what your expectations are, which you did. If the seller then says it does meet those conditions, then it is a deal. If he comes back later and says it doesn't he should either show the issues and offer a reduced price to see if you can work with it or just return the money and sell it to the next person with a new description to reflect what he discovered. We all make mistakes or miss things - it is how we deal with it afterwards that makes the difference.

    You are most certainly not being unreasonable. The part has issues which you expressly were concerned about. He discovered the issues that would have made you a non-buyer in the 1st place, and sounds like he knows that. Good he let you know about them, but he should also understand that drops you out of being a buyer.
    I've been a seller that had this happen. I sold a set of twin pipes off a snowmobile, and only discovered one of the expansion chambers was dinged when I pulled them out of the chassis. I immediately called the guy, sent him pics, and offered to either sell to him at a deep discount or gave him the option to back out. He took the discount, and we could both sleep at night.....
    This one isn't rocket science. Common sense should tell him to let you back out with no issue, and he should repost the part with a new, accurate description. No one is out anything but time.

    The seller could have been selling for someone else and didn't see it until time to ship. or maybe he has another buyer who offered more money and he wants out of the deal. Maybe photos of the issues would be in order? Either way you are in the right!

  13. Bob, the seller is the owner and he doesn't want to refund my money. he didnt offer a price reduction either.

    The seller has "your money", the "contract" is void upon the discovery that what he offered is not what will be delivered.

    It is not "his money" if you do not receive "what you paid for".

    Can't give an accurate answer with out knowing the details.. Is the seller finding a rotted out frame or did the radio stop working?

    It's certainly not right to judge the seller at this point.. good or bad.

    According to the post the seller admitted the item wasn't as described, what more detail is needed? He should refund or reduce, simple.

    I bought a Pertronix supposidly marine distributor cap off ebay. It was a fake and not marine grade, (although None of Pertronix marine stuff is marine grade at all), and the seller admitted it was not as described, so he refunded full purchase price and gave me the crappy cap without asking for me to return it.
    Ebay has lost it's credibility with me. I've voiced my concerns to them.... stick to your guns..

    The OP asked if he was being unreasonable. The questioned can't be answered without details. What are the issues and are they serious? If the OP is canceling the sale because the radio quit then he is being unreasonable. It's too arbitrary of a question to answered properly without more details.
     
  20. the seller knew my expectations before the deal was ever finalized. he knew the issue was a deal breaker and assured me there was no problem.. when he found the issue he contacted me to let me know about it. how can that be any less clear?
