What's the issue? Or are you negotiating with the Libyans to buy uranium and your not at liberty to say?

You're being reasonable Bob. In the seller's (partial) defense, I've had parts that were in "excellent" condition that I put away years ago and when I took them out maybe weren't quite as nice I'd remembered. Assuming that's the case here, he came back & said so and should've offered you the choice of a discount or to refund your money.

If it's an entire car with the issue, you can take my original post and put it in caps. He should either discount it enough for a proper repair to be made plus a bit for time and pita factor, or let you out free and clear.

  6. Thank you for the input, I was pretty sure my line of thinking was fair but I wanted to hear from others and see what your opinions were. I have reached out to the seller with an offer for a solution and hopefully they will agree that it is fair to both of us. it's not my wish to throw anybody under the bus.

I hope this works out. You stated your want/needs and were assured they were met. When seller discovered differently, money should be refunded.

Seller needs to refund or offer a discount. Buying and selling is getting tougher now with packages being stolen, scammers and fraud, etc. Certainly need to proceed with caution. Good luck.

I'm confused by this seller. He lets you know that he discovers the part is not is not as advertised at the last minute. My hats off to him to letting you know. But then he won't let you cancel the deal??? Or even offer a discount? Why even tell you before shipping?? Is he hoping you will say F'it and he will keep your money and the part?

  12. I think the expectation was that I would take delivery of the item anyway.

I think you are being way too nice. Yes 2nd hand is always different to new, but regardless if you expressly asked about issues and now they exist, deal off. Seller knew that in telling you, he knew it was going to be an issue....

If the newly admitted issues would have been deal-breakers at the beginning, why would they be acceptable now?

Take a deep breath. Sometimes "Time" helps resolve these type of things.

The seller is absolutely in the wrong for not wanting to refund your payment in full. HE screwed up here, not you. You told him what issues would be deal breakers, and he mistakenly told you these issues did not exist.

If this seller is a board member, and this issue is not resolved to your satisfaction soon, I'd say it's time someone got exposed here. It really sounds to me like this was a planned deception, in the hope you'd just say fine, ship it anyway.

It's important to know when these questions were asked. Before or after the deal was made?

Bob, If you paid for an item (solenoid, blower motor, car. truck, excavator, portable generator etc) and after the actual money transfer, he stated that it was not in the condition he described, you are in the right. If you took delivery and paid 'anyway' after he admitted the item was not as he described it, you need a couple paddles...poopy creek awaits.

  20. I'm hoping the end result is satisfactory for both myself and the seller. of course I asked all questions before committing to buy and sending payment. the seller did not mislead me and was honest about the problem once discovered. I appreciate his honesty in that regard.
