    Re: Rant time...

Put them on written notice that you are renting one that is comparable. Include the rate. The liability policy covers, loss of use ( in most states) as well as the cost of repair, and the diminution in value of a trailer with a damage history.

Rob, do what Jim Lore says... PRONTO.

Also, is Missouri a *no fault* state? :eek2:

We ran into a somewhat similar situation last year, and the few places I talked to wouldn't rent us a trailer? :Do No: Something about liabiilty, or some nonsense like that...so will some places actually rent enclosed car trailers?

Thanks for the help, guys. I'll be running the show hear @ work tomorrow, so I'm gonna try and make the insurance company do SOMETHING...at this point I don't care what that something is, as long as there is visible progress!

    The saga continues...

Well, we heard from the insurance company Saturday...unfortunately, it was NOT the insurance company of the vehicle that hit our trailer, nor was it that of the borrowed vehicle that caused the wreck, but the insurance of the driver of the vehicle that borrowed the truck and allegedly caused the wreck! even worse yet, they talked to mom, as dad and I were out of pocket, so we know no more than before, except that their is yet ANOTHER insurance company involved!

The other companies are calling us, except for the one directly responsible for payment/resolution...does that make sense? Nope. So, tomorrow morning, my FIRST call will be to the liable insurance company...if the designated representative fails to answer the phone or impress upon us that a resolution is in the works, then my SECOND phone call will be to our attorney whom we've already spoken with and handles insurance companies daily. I've gotten quotes for professionally transporting our cars to/from our show (SCR7), and believe me, the insurance company is not gonna like the prices. And last but not least, a THIRD phone call to the Missouri Insurance Division...we've dealt with them before, and they will stick their nose in there. We've been to court with them before over $50 funeral policies from over 75 years ago, so don't think they wouldn't be interested in this.

I still don't know what they're gonna do, as they drug their feet and missed the first reservation for repairs back at the Haulmark factory (Aug 9). The next one isn't till the end of August, which means we won't have our trailer for the very event we put on! :af: Y'all have helped and found us a couple of replacements (THANKS!) if it leads to that, but my guess is they're gonna string us along then try and get it fixed cheap...

Welp, finally got letters from all 3 insurance companies. The companies of the Dodge that actually ran through our trailer (AAA) and of the DRIVER of the vehicle that *allegedly* caused the accident (Allstate) both sent us letters denying responsibility, and both stated "our clients maintained complete control of their vehicle". Umm, "ok"?

Lastly, the insurance company (Shelter) of the actual VEHICLE that *allegedly* caused the accident informed us that they have a $10k TOTAL payment limit that must pay for not only our damages but those of the Dodge truck/trailer that hit our trailer! The a-hole that was driving the truck that made contact with our trailer is wanting a new truck & trailer as well as hospitalization, disability, loss of work, etc! Shelter got an estimate ($6900) on the repairs to our trailer and offered us that, but we're already out few thousand dollars on this deal because of having to have our cars transported TO OUR OWN SHOW and for having the trailer taken to a repair shop. And according to our lawyer, because of the type of case it is we CAN NOT sue for court costs, and his fees (he estimated a couple g's) will immediately come off the top of anything we *might* get. So to recoup our losses we're gonna have to go after AAA or Allstate, but we aren't guaranteed to get anything and the court costs will automatically come out of our pocket...so we're likely to be out at least a couple grand *at best* either way.

Moral of the story? We're out a few thousand dollars cause we were fortunate enough to have a nice trailer, parked on our own property, with us minding our own business...

Insurance, controlled by politicians, influenced by lobbyists, who exist solely to influence politicans, are organized crime. I thought these things were "handled" down there in "God's country", I'm depressed it's just like up here in lawyerland. (Sorry, John and Jim)

Whatever happened to Whoop- ass down there?  :blast:

I would turn it in to my insurance company.

My brother was involved in an accident where the guy hit him in the drivers side trying to pass him as he was making a left hand turn. It was a no passing zone and he tried to say my brother did not siganal is turn. The guy gets cited for passing is a no passing zone. The guys insurance company tried to only give my brother 3600.00 for his car after somebody came out and looked at it. My brother called his insurance company and they sent a guy out and said it was worth 4800.00. He turned in to his insurance company and they got the money and his deductible. Make the your insurance company go after them for the amount you are out. They have the lawyers on staff. I would not give up that easy.

    Just my thoughts

That's the pisser...our trailer is insured with Shelter, the same people that insure the *alleged* vehicle that caused the accident, and the same people that told us $10k is all they're spending, regardless of how it gets split up between all the claimants! :af: So, do we piss off our own insurance company? :Do No:

This crap always happens to me... :Dou:

Rob, one of my drivers in my new Tundra was involved in a near fatal situation as yours a couple months back, when a BIG Volvo box truck backed out of a driveway directly in front of him and he went under the rear of the box truck..the other driver only had 10k combined coverage for a fleet of 4 trucks, should be a law against that... anyways, call me sometime and i'll esplain how we are handling it, and coming out fine.. you ARE going to have to go after the driver that made the turn in front of oncoming traffic...

I would file the claim on my insurance company for the damage to my trailer. I has nothing to do with the insurance with the other guy even if they insure them. That is their problem. Do not let the insurance company push you around. I would fight back and if they say they will only pay so much take them to small claims court.

I would give them the estimates to fix all damage and expect a check just like if it caught fire and was damaged.
