Warning John, if you allow them to ride on YOUR property, YOU are responsible when they get hurt (and they will). You will be sued and will lose in any court of law in the land. They best thing to do is to post NO TRESPASSING signs up, have a heart to heart with those using your property and tell them, in front of the cops if necessary, NOT TO USE YOUR PROPERTY FOR THEIR ENTERTAINMENT. PERIOD!! Signatures are always recommended in such instances

See it here all the time as well. Witnessed 3 kids on a 4 wheeler doing 50+ down the road in front of my house with out any safety gear. At least once a yr a local kid gets killed on one of these machines. Call the sheriff and the dep responds saying " whats the big deal, I used to ride this area when I was a kid" But when you were a kid this was all vacant land....... now its developed with 1/4 - 1/2 mil homes and we dont want it here.
Easments are a pain in the ass. We were in a 4 year lawsuit over mine. I will advise anyone wanting to buy property with an easment, to pass on it.
You may try to play the system. Start a petition and gain strength in numbers. You can't be the only one annoyed with atv traffic. If you can get 1000 plus signatures you might be able to change the law. If you can't, well then I go back to my earlier suggestion of moving.
How about planting a bunch of trees or adding some 'landscaping' boulders? Or plow it and plant some corn? The point is to find out what you CAN do with the property to make it undesirable for the off-roaders.
Was wondering the same.. If the land is not used for anything, make it undesirable.. Random holes, stones, cut down threes and so on would stop them.. When their equitment has broke, or they have been injured enough, I would imaging they'd find some other place to ride..
No easement issue, although I agree that easements are a PIA. I passed on a house in Bellingham, MA because of an easement issue. My problem is a lazy, incompetent lawyer.
If they authorities wanted to pursue it they would find residue on the kids hand or hands if he fired a pistol! Bob H.
I had kids on 4 wheelers going thru my property on a trail my son had used....it was a neighbor's kids so I let it go on for a while...suddenly it stopped the same time my cat went missing...found him dead on the trail....of course they never apologized.....
I appreciate the support and responses. I will not be the one to commit the felony rest assured. I have found the loophole in my deed that will allow me to close the easement to all but the utility/cable companies. I will not do anything covert to intentionally hurt anyone. I am gonna win this legally. I have posted signs "Easement Closed October 1, 2019". So now they are trowing trash over my fences and I must walk fence lines 2-3 times a day to keep the horse from ingesting anything toxic. I've talked to them all, I talked to their parents and now some of the parents have threatened to have me charged with stalking their kids (16-19 years old) if I ever talk to them again. I've never cursed or yelled at them or their parents, just trying to come to some sort of understanding to protect my wife, daughter and horses. No offense to anyone but these country rednecks are about the most self centered, nu-neighborly, worthless people I have ever dealt with and I grew up in the projects in New York. Mikey
Coax them onto your property and call them onto a fight, let them jump you and beat you a bit. All the while your wife is videotaping the incident from nearby. Have a friend "suddenly" appear to break up the fight and thwart off the unwanted guests. Then call the police and tell them you and your friend were riding your horses while your wife was taping you and happen to get the whole thing on video tell them you were assaulted on your own property. Now they will be charged with trespassing and assault.
Good for you Mikey. That's a great plan. Keep your head up and keep picking up the trash, chin up these suckers cant phase you. Sooner or later they will stop and move on to girls or _____. There parents are weak, when an adult came to my house and told my parents I did something they always sided with the adult. Seems like they need the punachi sticks or how ever they are called lol. Wave to those punka$$ kids so they dont try nothing cowardly, since we can see they are from the action of throwing trash. Trail cam them for something to have in your back pocket IF YOU want to pull it. I'll pray for you man
One of the parents here did the same thing and I got served to appear in court. Seems the kid told her I was tring to coax him into my truck for less than honorable reasons. When I went to court the judged asked me if I would defer and not talk to the kid. Looked the judge in the eye and let fly. told him exactly what was going on. then opened up on the mom. Told her the only time I ever asked the kid to get into my truck was when he had crashed the bike and I had to pick it up off him while he was on the ground crying. asked if he needed a ride home. Apparently she didnt know anything about that. Judge threw the injunction out. after a few months the kid stopped tearing up the neighborhood. Several months ago a young man approached me on the loading dock of the local building supply, He said Remember me? Im like no not really.... Kid says Im Rickey from the neighborhood and Im sorry for all the stuff I did... Talked to him for a few mins as he loaded my order. Alls well that ends well.
One of the parents tried that. He came to my house when he saw my truck gone and told my daughter he was gonna pound me knowing I would go to his house to remind him his wife said said the kids were off limits. He had his buddy there, an off duty trooper (I knew he was a trooper as I'd seen him there in in uniform with the State car when I'd passed their house previously a few times. Anyway he comes running up to me screaming expletives and gets 12" from my face still screaming hoping I'd swing. I just stood there calmly ignoring him looking at the trooper till he quit, once he realized I wasn't gonna bite. Then I softly reminded him of his request to leave kids off limits and that he's gone and yelled at my daughter. His mom was there and grabbed him scolding him for yelling at my daughter. We discussed his kids spooking the horses making it dangerous for us to work/groom them and neither of us wants our family hurt. His kids have ceased to be a problem since. Now if I could get the troopers kids to quit... I have trial cams and save issues I need. Mikey
