Ebay problem

    I bought a timing chain set that was supposed to be new on ebay.
    As soon as I opened the box I knew it was used. Marks where the cam bolts were, marks from the chain digging into all sprockets and some leftover blue silicone on the chain!
    When I asked him what he was going to do about it, the guy insists that it was new, implys that I am pulling some "funny business"....goes on to threaten me and says I own it.
    Goes on to say that I must be a GSX wannabee and a Chevy/Ford/Mopar defector AND that he has forgotten more about Buicks than I will ever know!

    The ONLY negative feedback (2) I have on Ebay is from items I bought. My sales feedbackis 100% positive.

    What would YOU do in this situation? (no, it's a little far to send BIG Doug H.)

    I am not naming the individual as he is a BPG message board member and I have some class.

    Maybe it's time for a 'Buyer/Seller' evaluation on this board :Brow:

    I agree. However I would mention his ebay name on the buyers sellers feedback area so that we can be wary of these types. Sorry to hear you had the bad luck,:beer

    Yes, feedback was left by both of us. I am not naming him out of courtesy in case he desires to have one chance to make things right. But the way he acted it is not likely. But I have faith in people....although it gets tested sometimes.

    It's too bad low lifes have to make scenes like this and put everybody on guard.
    Here's my suggestion. If digital camera is available, shoot the item. Send seller the pic thru email...perhaps he sent the wrong item...never know...this also sets a parameter...why would you install new chain/gears only to remove them to complain and get a new set... Try one phone call, but do not harass. After that, try Square Trade on ebay...not a lot of clout, but may ruin status if seller is a power seller etc. They send the complaint to him etc

    If your check was sent via mail, you're in. For future reference in a squabble,no neg feedback till 90 days (hopefully matter can be settled amicably), and if you decide to then, make every syllable count.

    Steve I was thinking of taking a pic or sending the set back to him (COD, haha) but figure he will just say it's not the one he sent me. Plus then the evidence is gone.

    I have witnesses who were there when I opened it but they are just my kids....my 11 yr son noticed it was used before I did. I had faith in what I thought I bought.

    I got negative feedback from a seller who swore he'd provide a picture to me of the part before the auction ended. It ended, I was high bidder, and after 3 weeks he FINALLY sends a picture - of a mistakenly posted '69 part !! :stmad:

    I told him Im not buying it.....and he left negative feedback.

    I wont tell you what I did next, but "Revenge is a dish best served cold" and it tasted YUMMY !!!
     
  8. Bruce, JW doesn't take kindly to board members getting "taken" by other board members, even if the sale took place on ebay. If the seller doesn't remedy the situation, please send Jim a PM or an email and tell him what has happened. If you do not get satisfaction in the end, please use the buyer/seller feedback forum to warn the rest of us.

    Second user name for buying

    Hi Bruce,
    If I were you I would have a second user name on eBay for buying. I have a second user name just for this purpose. A friend of mine said I should do that. How did you pay for the timing chain? If you used PayPal you may be able to get your money back. Here is PayPal's #1-888-221-1161. If I were you I would call eBay 1-800-322-9266. They can not do anything over the phone for some reason. But if anything can be done they will send you an email with the right way to handle this. Good Luck.

    Bob, unfortunately he wanted cashiers check or postal MO. (no PAYPAL). I used postal MO.

    The thing is his ebay ad did not say new though it was on (in) the original box so it gave the impression of new. His email though does insist new off the shelf where he worked. I even suggested that maybe the store got a used one back....but that notion was quickly rebuffed. He said he was the manager and that could not have been the case. Would have been an easy way out for him.

    It sounds like you will not be able to do much about it through eBay. I would get another user name for buying. Some people look down at the negitives on eBay. I have over 600 positive feedbacks with no negitives and I feel better using the other user name for buying. I have been burned a couple of times and had to suck it up and deal with it and move on because I did not want a negitive. Now that I have the other user name it does not matter as much now. Good Luck

    Hey.....First off I just want to say, that, for those that dont know Bruce - He's one of the Nicest, decent, sincere gentleman I've ever met. I always look foward to spending time at events talking with him.

    Monsters Multiplying ?? Ha !! Seems that way.....haven't done SQUAT to the sporty since getting the "monster - they're THAT nice. If I could Swap bodies I would. My wife drove mine for a week and decided her '96 Subaru was a P.O.S. compared to driving a Monster soooo I bought her one of her own :Dou: :Dou: The Parts Wagon kinda followed me home one day..... after selling some B.S. pieces off it , it cost me less than $400 with a MINT body and an LT1/4L60E/posi rear as well as ALOT of other parts to keep my garage cluttered - I STILL haven't finished picking the CARcass clean :Dou: :Dou: :Dou:

    Family obligations (read that a wedding of a friend of hers I didn't want to attend) Kept me from Cecil this year.

    By the times guys were posting, I prolly would have broke into the 11's and been perminantly BANED from the state of MD :laugh:

    Missed talking with you.....Have a GREAT holiday season and Dont sweat the Loosers that ruin Ebay / For Sale forums. I've won alot more times than I've lost and write off the losses as a leasson learned as well as a chance to let my dark side out in revenge

    Let me first start by saying I have known Bruce since the late 70's when we met at the track (since we both had Buicks) and he was racing his stock 1970 GSX Stage 1 in the high 12's. He also owns more Buicks than any rational man. With that said I have to say there is some blame on both parts here for this transaction gone bad.

    I have seen the parts in question in person and the gear has been mounted before (marks from bolts on gear) and the chain does not fit properly. Even if you look at the ebay ad and have a good monitor (like I have at work and not at home) you can see that bolt marks on the gear. It did not appear to me to have much wear but how much is NEW? There was also some blue sealant on the chain.

    The ebay ad did not say the timing set was new only that the other timing gear included in the deal was new NOS and it was. It was also probably worth what he paid for both the gear and the timing set. The seller did tell Bruce in a subsequent email that it was all new or NOS and he did not know what he was talking about.

    Bruce's email to the seller had some tone (but no swearing yet):
    **** "WHAT'S THE DEAL MAN? THIS TIMING SET IS USED! YOU HAD A PIC OF IT ON THE BOX LIKE IT WAS NEW. IF IT WASN'T YA GOTTA SAY SO!!!!! WHAT ARE YOU GONNA DO ABOUT IT?" ****

    The seller's reply accuses Bruce of wrongdoing:
    ****** "bruce what are you talking about..? the timing set is brand friggin new..
    everything is as it was described..the set is NEW..... now I pose the question what kinda funny business are you trying to pull?....I dont appreciate you making this accusation....the timing set is new as is the nos gear which in my opinion is what you paid for to begin with, but nonetheless its all new/nos. and you got a great deal....next time get your facts straight before you shoot then ask. " ******

    Then it got worse with Bruce swearing and then the seller threatening to tell Bruce's employer how he spends his days (very low) and tells him he knows nothing about Buicks.

    Well Bruce should have been nicer with his first and subsequent emails and offered to send photos but the seller was also too sure of what was sent and never offered to make it right probably because Bruce had already pissed him off.

    well, i think you would do all of us a favor by letting us know who th schmuck is. i dont want him ripping me off with an ad.

    it seems the value of his pictures show how his own words are lies, making him a thief.

    If there is a rat, he should be exposed regardless if he is a member here or not. As David mentioned, Jim does not tolerate this type of behavoir. Good luck

    Bruce what was the complete cost of the transaction? In other words, How much $$ are you out? Here's my opinion based on the "facts" in the previous posts: Seller pulled a fast one. Was an obvious misrepresentation based on the ebay auction description...the wording, or lack thereof, the pictured box. And NO USE of the word "used". Seller should of offered refund at first complaint. There should have been no need for harsh words were the correct action taken (refund)I'm thinking less than $50, otherwise Bruce would of got one regular retail. Bruce?
    You can get satisfacton by taking buick business from the seller by blackballing him here. ( I would make a final attempt to rectify situation amicably first...more than likely the seller is aware of this thread and may come to his senses)And as stated before, file with ebay, see how it plays out, and if still dissatisfied, file USPS fraud complaint form through link above.
    Two addages com,e to mind:
    A) Live and learn, Bruce
    B)For the rest of us...Learn from other peoples mistakes.

    Mike, I'm surprised (well not too much) that you say I am to blame also. I was just the innocent buyer and yes I was pissed off. You might be too.....
    If a part is on the original box I think it is assumed to be NEW unless otherwise stated. Also, as you stated he said it was NEW in the subsequent email.

    Here is a pic of the item in question from the EBAY ad. Mike, you must have alot better monitor than I do cuz I sure can't see the wear in the pics.

    I paid $58 shipped. As it comes down I really paid that for the stock cam gear....not a good deal now since the timing set is useless to me used.

    i can see the wear around he bolt holes on th large dark sprocket .... but had to fiddle with th pic to bring it out.
    if the ad said new .....its deception anyway.
